Special Called Meeting

MISD School Board - January 28, 1998

ACTION REPORT

A. CALL TO ORDER - Meeting was called to order by President Keith Alston, at 7:30 p.m. Opening Prayer was given by trustee, Arthur Douglas. Pledge of Allegiance was lead by Arthur Douglas. All board members were present for Roll Call.

Public Comments: None

District's Status Regarding the Instructional Facility Allotment Application - Doug Whitt with Southwest Securities and W. Jeffrey Kuhn, Attorney At Law, with Fulbright & Jaworski, gave a report to the board. Mr. Whitt presented each member a booklet and briefed the board on it's contents. Mr. Whitt and Mr. Kuhn answered questions asked by the board. Mr. Whitt brought to the board's attention a letter from the office of the attorney General stating "that the Notice of Intention as published only authorizes the school district to enter into a lease-purchase contract for a new elementary school. A facility housing grades six through eight is not an elementary school."

The board recessed for ten (10) minutes.

Motion by trustee Mrs. Billie Jones, seconded by trustee Ms. Rosie Sedillo, for the board to authorize, the superintendent to amend the Instructional Facilities Allocation Program application to conform with the resolution adopted on October 7, 1997. The motion carried unanimously.

Electronic Recording for Closed Sessions -Motion by trustee Mr. Keith Drews, seconded by trustee Ms. Lowanda Washington, to continue to have a certified agenda for closed sessions. The motion carried unanimously.

Closed Session - The Board went into Closed Session at 9:08 p.m. The Board came out of Closed Session and reconvened to open session at 10:15 p.m.

Representatives to attend Case-Barbara Smith vs. Marlin ISD - Motion by trustee Ms. Elaine Truett, seconded by Mr. Arthur Douglas, that Lowanda Washington, Rose Sedillo and Keith Alston be the representatives to attend court ordered mediation in the case styled Barbara Smith vs. Marlin ISD, Civil Action No. W97CA291 under the terms discussed in Closed Session. Voting for the motion: Ms. Elaine Truett, Mr. Arthur Douglas, Ms. Billie Jones, Ms. Rose Sedillo, Mr. Keith Drews and Mr. Keith Alston. Ms. Lowanda Washington abstained from voting. The motion carried.

Keith Alston - Read a letter from Kip Averitt, State Representative, District 56. The letter expressed appreciation to the Board members for their service to the school and community by serving on the MISD Board.

Billie Jones - Expressed appreciation to the campuses for their thoughtfulness during Texas School Board Month.

Adjourned - President Alston adjourned the meeting at 10:18 p.m.
